Unfortunately there appears to be some confusion in relation to who had carriage of the Order in respect of the last hearing.
Having taken advice, and on the basis this was very much your application, it was down to you to draw up the order if the court were not to do it themselves.
We have been in touch with the court over the last few weeks after the hearing and were told that everything was in order and it was in for typing.
Rather than waste time, perhaps it’s appropriate for your barrister to draw up a draft order and to forward the same to us for our approval. Once approved we can both then write to the court.
In relation to the costs order, it is proposed that there be an application for a stay of execution. We are experiencing temporary cash flow problems and would propose a payment program of four instalments of £5625 commencing 19 September and continuing through 19 December 2014.
Please confirm whether you approve that proposal.
If not we shall be forced to make an application.
If finances do improve then it is hoped that the balance outstanding may be discharged more expeditiously.
