HH Judge Robert Owen QC ordered on Wednesday 13th August 2014 that Whitehall Franchise UK Ltd (formerly known as Gateway Homes Nationwide Franchise Ltd), Gateway Homes UK Ltd, Nick Statman and Malcolm Statman have 28 days to pay me £22,500 on account (i.e. an interim payment, pending detailed assessment) in Claim 3BM90158 and 3BM90159.
On the issue of a claim for damages this was withdrawn by my Counsel on discussing directions and relevant merits under these current proceedings from HH Judge Robert Owen QC highlighting the narrowness of the law to which we would be working under. A new Claim would be far more relevant and pertinent giving wider scope and far greater likelihood of success – this has already been on the horizon for months as was also the opinion of HH Judge Oliver-Jones QC in June 2013.
Have to say the hearing was in stark contrast to the trial when the Claimants were represented by their ex-solicitor Miss Emily Slater and a veritable feast of Counsel consisting of Mr Matthew Richardson and Mr Adam Richardson ….. Ms Clare Painter was granted permission to address the court in a Mackenzie-friend type of role on behalf of Mr Nick Statman as a litigant in person. Obviously times are hard as when asked how much they would offer on account the response was £5,000 when the request from the defence was for £50,000. The Judge opted initially for £30,000 and then reduced on agreement by both parties to £22,500. When told normally 14 days would be given Mr Nick Statman requested 60 days ….. Judge went for 28 days being reasonable.
So, they have my bank details and we await receipt of monies by 4pm 10th September 2014!! Meantime we will crack on with providing yet more detail of how I spent my time defending the case …. so then we will be off to see a Costs Judge to assess how much more will have to be paid. It’s one hell of a learning curve this Civil Law stuff!
